Google’s Gemini chatbot could infringe publishers’ rights when reusing news content in certain circumstances, an adviser to the European Union’s highest court said on Tuesday.
Advocate General Maciej Szpunar issued the opinion in a case brought by Hungarian publisher Like Company.
He said infringement could arise when a chatbot circumvents access restrictions or recognisably reproduces a publication’s expression. Copyright protects how information is expressed, rather than the underlying facts.
The opinion is advisory and does not constitute a final judgment by the Court of Justice of the European Union.
